These Terms of Service (the “Terms”) govern your access to and use of ufitjourney.com and any related pages, content, features, products, and services (collectively, the “Services”).

The Services are operated by Nature Origin Tech LLC, doing business as U+FITJOURNEY (“U+FITJOURNEY,” “we,” “us,” or “our”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

By visiting our website, creating an account, or purchasing from us, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy, Return & Refund Policy, and Shipping Policy are incorporated into these Terms.

1. Eligibility and account responsibilities

You must be at least 18 years old, have reached the age of majority where you live, and be legally capable of entering into a binding agreement to use the Services or place an order. The Services and our products are not intended for minors.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly if you believe your account has been used without authorization.

You may not use the Services or our products for any unlawful or unauthorized purpose.

2. Health and product information

Content made available through the Services is provided for general educational and informational purposes only. It is not medical advice and is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.

Always read the product label and follow the directions and warnings provided with the product. Consult a qualified healthcare professional before using a dietary supplement, particularly if you are pregnant or nursing, take medication, have a medical condition, are preparing for surgery, or have questions about whether a product is appropriate for you. Stop use and seek professional advice if you experience an adverse reaction. For a medical emergency, contact emergency services immediately.

Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Dietary supplements are not intended to diagnose, treat, cure, or prevent any disease. Individual experiences and results may vary.

Any quiz, recommendation, article, testimonial, review, or other content available through the Services is informational only and does not create a healthcare-provider relationship. Product recommendations generated from information you provide are not medical recommendations.

3. Products and availability

We make reasonable efforts to describe and display our products accurately. Packaging, colors, labels, ingredients, specifications, and other product details may change, and the display on your device may not exactly match the physical product. Please review the product label you receive before use.

All product descriptions, prices, promotions, and availability are subject to change without notice. We may discontinue a product or limit quantities by person, household, account, payment method, billing address, shipping address, geographic area, or order when reasonably necessary.

Our online store currently accepts orders for delivery to the 48 contiguous United States and Washington, D.C. We do not currently ship to Alaska, Hawaii, U.S. territories, APO/FPO/DPO addresses, or international destinations. We may change the locations we serve at any time.

4. Orders and acceptance

Your submission of an order is an offer to purchase. An order confirmation acknowledges receipt but does not mean that we have accepted the order. We accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance.

We may refuse, limit, or cancel an order before acceptance for reasons including product availability, suspected fraud or policy abuse, payment or pricing errors, shipping restrictions, or inaccurate customer information. If we cancel an order after payment has been captured, we will refund the canceled amount to the original payment method.

You must review your products, quantities, shipping address, and payment information before submitting an order. We will reasonably try to accommodate a cancellation or change request, but we cannot guarantee a change after an order enters fulfillment.

5. Prices, taxes, and payment

Prices are shown in the currency displayed at checkout and may change at any time before purchase. Taxes, shipping charges, duties, customs charges, and other applicable fees will be displayed or described at checkout when reasonably possible. You are responsible for charges not collected by us but imposed by your jurisdiction or carrier.

By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge all amounts associated with your order. Payment processing is also subject to the terms and privacy practices of the applicable payment provider.

We may correct typographical, pricing, promotional, or other errors. If an error affects an order you submitted, we may contact you for instructions or cancel the affected item and issue an appropriate refund.

6. Shipping and delivery

Shipping estimates are estimates, not guaranteed delivery dates, unless we expressly state otherwise. Delays may occur because of carriers, customs, weather, high order volume, incorrect address information, or events outside our reasonable control.

Please review our Shipping Policy for available destinations, processing estimates, delivery estimates, tracking, customs charges, and other shipping terms. Questions about delayed, lost, refused, or undeliverable packages are handled under the Shipping Policy and our Return & Refund Policy, subject to applicable law.

7. Returns and refunds

Returns, refunds, replacements, and our first-order 60-day money-back guarantee are governed by our Return & Refund Policy. The policy includes eligibility conditions, deadlines, required return authorization, product-return requirements, shipping costs, and exclusions. For an eligible satisfaction-based return of an order that received free shipping, customer service may assess an outbound shipping and fulfillment deduction based on the actual order and third-party costs. We will communicate the proposed deduction and estimated refund amount for your confirmation before authorizing the return. Nothing in that policy limits rights that cannot lawfully be waived.

8. Promotions, discount codes, and gifts

Promotions and discount codes may be subject to separate terms shown with the offer. Unless stated otherwise, offers cannot be combined, have no cash value, and may be limited or withdrawn before use. A refund for a discounted item will not exceed the amount actually paid for that item. Free or promotional items may need to be returned when the qualifying purchase is refunded, as described in our Return & Refund Policy.

9. Intellectual property

The Services and their content—including trademarks, logos, product names, text, graphics, photographs, videos, designs, software, and arrangement—are owned by or licensed to U+FITJOURNEY and are protected by intellectual-property laws.

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for lawful, noncommercial purposes. Except as permitted by law or with our prior written consent, you may not copy, reproduce, modify, distribute, sell, license, scrape, frame, reverse engineer, create derivative works from, or commercially exploit any part of the Services.

10. Reviews, submissions, and feedback

If you submit a review, photograph, comment, testimonial, suggestion, or other content (“User Content”), you retain any ownership rights you have. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, reproduce, adapt, publish, translate, display, distribute, and otherwise use that User Content in connection with operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

You represent that you have the rights needed to submit the User Content and that it is accurate based on your honest experience. User Content must not be unlawful, misleading, defamatory, infringing, harassing, obscene, malicious, or contain another person’s confidential information. We may moderate or remove User Content, but we have no obligation to do so.

Feedback and suggestions may be used without restriction or compensation, but we will not publicly identify you in connection with feedback unless permitted by you or by law.

11. Third-party services and links

The Services may contain links to or integrations with services we do not control, including Shopify, payment providers, carriers, social networks, analytics providers, and advertising partners. Your use of a third-party service may be governed by that party’s own terms and privacy policy. We are not responsible for third-party websites, products, content, or practices, except to the extent required by law.

12. Prohibited conduct

You may not:

• violate any law, regulation, or third-party right;
• submit false, misleading, fraudulent, or malicious information;
• interfere with the security, integrity, or operation of the Services;
• introduce malware or use automated means to scrape, probe, or overload the Services;
• impersonate another person or use another person’s payment information without authorization;
• manipulate reviews, promotions, referrals, returns, refunds, or chargeback procedures; or
• use the Services to transmit spam, harassing content, or unlawful material.

We may suspend or terminate access, cancel unaccepted orders, or take other reasonable action if we believe these Terms have been violated.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INFORMATION AVAILABLE THROUGH THE SERVICES WILL ALWAYS BE COMPLETE OR CURRENT.

PRODUCT WARRANTIES, IF ANY, ARE LIMITED TO THOSE EXPRESSLY PROVIDED WITH THE PRODUCT. THIS SECTION DOES NOT EXCLUDE ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, U+FITJOURNEY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT, AND OUR TOTAL LIABILITY FOR ANY OTHER CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or non-waivable consumer rights.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold U+FITJOURNEY harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify us for our own unlawful conduct.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware and applicable federal law of the United States, without regard to conflict-of-law rules. Subject to any mandatory consumer right to bring a claim elsewhere, the state and federal courts located in the State of Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Services.

Before filing a formal claim, you and U+FITJOURNEY agree to make a good-faith effort to resolve the dispute informally by written notice. Send your notice to support@ufitjourney.com and include your name, order number if applicable, a description of the issue, and the remedy requested.

Nothing in these Terms limits rights or remedies that cannot be waived under the law where you live.

17. General terms

If any provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent; we may assign ours in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

These Terms and the policies incorporated into them are the entire agreement between you and us regarding the Services and supersede prior or contemporaneous communications about their subject matter.

18. Changes to these Terms

We may update these Terms to reflect changes to our Services, practices, or legal obligations. We will post the revised Terms with a new “Last updated” date. Changes apply prospectively when posted or on a later date stated in the notice. Your continued use of the Services after the effective date means you accept the revised Terms, to the extent permitted by law.
